§1
General provisions
1. The online store [hereinafter referred to as the "Store"] conducts retail and wholesale sales via the Internet, based on these Regulations [hereinafter referred to as the "Regulations"].
 
2. The owner of the Store is: Flash-Butrym sp.j. with its registered office in Skarbimierzyce 18, 72-002 Dołuje,
NIP: 852-182-13-82, REGON: 812052764, KRS: 0000083838, BDO: 000006062

3. The Regulations are an integral part of the sales agreement concluded with the Customer.
4. The condition for concluding a sales agreement is the acceptance of the Regulations by the Customer.
5. The goods available in the Store are free from physical and legal defects.
 
§2

2. The condition for the execution of the order is the provision by the Customer of data allowing for the verification of the Customer and the recipient of the goods. The Store confirms the acceptance of the order by e-mail or phone. The store has the right to refuse to accept an order, limit the method of payment or demand prepayment if the order raises reasonable doubts as to the truthfulness and reliability of the data provided or the method of payment.
3. The parties are bound by the information contained in the regulations for the purchased goods at the time of placing the order, in particular: price, characteristics of the goods, its features, elements included in the set, delivery date and method.
4. The information on the website does not constitute an offer within the meaning of the Civil Code. When placing an order, the customer receives an offer to purchase a specific product, then the sales agreement is concluded when the Customer confirms the Order.
 
§3
Payment Methods
1. The customer has two payment methods to choose from:
- "Prepayment" transfer - payment should be made to the indicated bank account number, which we will provide you with in an email confirming the acceptance of the order for processing. You can make the transfer online, at the post office or at the bank. After the payment has been credited to our account, we will start processing the order.
 
- Cash on delivery - payment upon receipt of the goods up to the value of PLN 2,000. This payment method involves a higher order fulfillment fee, increased by the value of the courier service provided by an external company. There is no higher fee in the case of payment by bank transfer.
 
§4
Shipping Cost / Delivery Methods
 
1. We send parcels by courier company "DPD Polska".
Bank transfer:
- One parcel weighing up to 31.5 kg in Poland.
Net price: PLN 22
Estimated delivery time: 1-2 business days.
- One parcel weighing up to 31.5 kg in the European Union.
Net price: individual valuation
Estimated delivery time: 2-7 business days.
 
Cash on delivery: (cash payment)
One parcel weighing up to 31.5 kg in Poland.
Net price: PLN 22/pc + one-time fee of PLN 8 regardless of the number of parcels.
Estimated delivery time: 1-2 business days.
- One parcel weighing up to 31.5 kg in the European Union.
Net price: individual quote
Estimated delivery time: 2-7 business days.

2. We send pallet shipments via the courier company "Raben".
Individual quote - the cost of a pallet shipment depends on the weight and dimensions, and the place of delivery.

3. Other forms of delivery:
- Personal collection at the company's headquarters: on the agreed date.
- Through an independent collection order, through external courier companies: on the agreed collection date.
*The ordering party assumes responsibility for the order upon delivery of the goods.

Additional information:
* the cost of delivery may change in the case of products with non-standard dimensions and/or greater weight.
* The condition for the delivery/dispatch of the goods is the posting of payment for the entire order to the bank account.
* The recipient is obliged to check the condition of the shipment and its contents in the presence of the courier. In particular, pay attention to the condition of the tapes or seals affixed to the parcel. If the packaging of the parcel shows signs of damage or if the seals (tapes) are broken, the parcel should not be accepted and an appropriate complaint protocol should be drawn up and then the Store should be immediately informed of the situation. Only a protocol drawn up upon receipt of the parcel, in the presence of the courier, entitles the Store to submit complaints in the form of shortages or damage to the goods. It does not apply to other forms of delivery.

§6
Order processing time / Availability
The waiting time for the parcel consists of the period of order processing in the store and the time of delivery of the parcel by the carrier: "DPD Polska" or "Raben". The customer can also independently choose another carrier, taking responsibility for the goods upon receipt. The waiting time for the parcel depends on the selected form of delivery: waiting time = processing time + delivery time.
The processing time of orders placed with Flash-Butrym Sp.J. depends on the availability of the goods in the store and from suppliers. If the goods are in the Flash-Butrym Sp.J. warehouse. then the parcel is sent within 24 hours. In most cases, the delivery time is 2 business days. However, there are items whose availability from suppliers is limited. Then the delivery time may be longer, which results in the Store contacting the customer to arrange the details of order fulfillment. When paying by "prepayment" transfer, the order will be sent after the payment is posted by Flash-Butrym Sp.J.

* In order to properly fulfill the delivery, remember to provide accurate address data, including postal code and phone number.
 
We make every effort to ensure that the product availability presented on the website corresponds to the real stock levels. However, it may happen that the actual delivery time may be longer, of which we will inform the ordering party immediately.
* If you order a larger number of products, the shipping time of the entire order is adjusted to the product with the longest shipping time.
*You can complete your order in stages - to do this, please contact us to arrange the order details.
 
§7
Return of goods after tests
1. The contractor to whom the equipment is made available for testing is obliged to sign a proforma invoice with a payment term of 30 days.
2. Based on the signed document sent, the warehouse issues or sends the equipment.
3. the contractor is obliged, at its own expense, to return the equipment and fill out the return form by the payment date specified on the invoice.
4. After checking the condition of the returned equipment by the Flash-Butrym service, a corrective invoice will be issued.
5. If the user does not return the equipment by that time or does not complete the formalities, a VAT invoice for the proforma invoice with a payment term of 7 days will be issued for the equipment. Refusal to accept the invoice or failure to pay on time may lead to debt collection.
 
The returned product should be complete and must be sent back in its original packaging. You must send the return shipment at your own expense.

§9
Right to withdraw from the contract
Pursuant to the Consumer Rights Act, Journal of Laws 2014, item 827 of May 30, 2014, the Customer has the right to withdraw from the contract.
 
Information on exercising the right to withdraw from the contract, instructions on withdrawal from the contract.
1. The right to withdraw from the contract is effective if the Customer submits a declaration of withdrawal from the contract to the Store within 14 days of receipt of the goods. In order to exercise the right to withdraw from the contract, the Customer must inform the Store of their decision and withdrawal from the contract by means of an unequivocal statement:
- In writing to the Store's address; Flash-Butrym Sp.J., Skarbimierzyce 18, 72-002 Dołuje.
- By e-mail; info@flash-butrym.pl.
2. The Customer returns the goods to the Store within a period not exceeding 14 days from the date of submission of the declaration of withdrawal from the contract. The returned goods should be intact, including completeness, in the factory packaging, and may not bear traces of use. The costs of return shipping are borne by the Customer.
3. Within 3 working days of receiving the shipment, the Store will check the condition of the delivered product.
4. Within 14 days of receiving the goods, the Store will return the paid amount to the Customer, reduced by any costs incurred in fulfilling the order.
5. In the declaration, the Customer should indicate the bank account number to which the refunded amount is to be transferred. In the case of payment by payment card, the refund will be made to the card.
6. In the event of a breach by the Customer of the conditions specified in the right to withdraw from the contract, points 1, 2 and 3. The declaration of withdrawal from the contract is ineffective, the goods are not subject to return and the Store will not return the paid amount to the Customer.
7. If your product return is rejected (due to violations of points 1, 2 and 3), we will send you information about the rejection of the product return to the specified email address. Within 7 working days, we will send the product back to the specified return address, covering the shipping costs. Exceptions to the right to withdraw from the contract. 

The right to withdraw from a contract concluded outside the company's premises or at a distance does not apply to the consumer in relation to contracts Art. 38 of the Consumer Rights Act, Journal of Laws 2014, item 827 of 30 May 2014

Flash-Butrym Sp. J. allows the use of photos, descriptions, instructions and films downloaded from our websites only for marketing purposes related to the authorized distribution of the brand. Files and fixtures may be used only for the purposes of servicing purchased devices.
 
§13
Entry into force and changes to the Regulations
1. The Regulations enter into force on the date of publication on the Store's website 22.02.2024
2. The Store reserves the right to change the Regulations, which enter into force on the date of publication on the Store's website.
3. For contracts concluded before the amendment of the Regulations, the version of the Regulations in force on the date of placing the Order by the Customer shall apply.
